Terms and Condition for “Teraportal” service

This terms of “Teraportal” service (hereinafter referred to as the “Terms”) governs the relationship between you, the third party and the “Teraportal” service, on the use of the “Teraportal” service by you, the use of intellectual activity posted and available in the “Teraportal” service, the interaction between you and the third party, and other issues arising in connection with this.

1. GENERAL DEFINITIONS

For the purposes of this Terms, the Parties use the words and expressions used herein with the following meanings. The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Service - refers to administrator of the Service, but not copyright holder exclusive rights or the holder of licensing rights in relation to the intellectual property posted within the Service, and to ensure its functioning. It can also refers to the “Teraportal ” website, intended for accessing Content by Third parties with Users’ access to the Service through Internet browsers, or through special software installed on User devices.

Third-Parties – parties that are not the User and the Service, means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service

Content – ​​Video content, as well as live broadcasts of television and radio channels, podcasts, audio programs, news, articles, performances, phonograms, other results of intellectual activity posted and available on the Third-parties’ Sites, their TV Channels, as well as any information about such results of intellectual activity activities, including schedules for displaying Content on television or radio, television and radio programs, etc.

Country - The country or nation that the Third Parties are based on, or where users are based on depends on the use. Country as a physical entity is defined by the United Nations.

User – the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Device - any device that can access the Service such as a computer, a cell phone or a digital tablet.

Intellectual property - all intellectual properties posted within the Service, including logos, visual design, individual design elements and the design of the Service as a whole, included in the Service.

Channel - a collection of television or radio programs and other audiovisual, sound messages and materials formed in accordance with the broadcasting schedule (program schedule) and published under a name and with established frequency. A television channel is a registered media outlet distributed by a broadcaster.

2. Subject of the Agreement and Acceptance and Change of Terms

2.1 These terms and conditions govern your access to and use of the Teraportal service, which allows you to view or listen to content for personal, non-commercial, non-business purposes.

2.2 By using the Service, you fully and unconditionally accept the terms of this Agreement. If you have not read the terms of the Agreement, this does not relieve you of responsibility or cancel your acceptance of the Agreement.

2.3 We may make changes and additions to this Agreement at any time. The current version of the Agreement will be available on our website. You agree to regularly check for changes and additions to this Agreement. Your continued use of the Service after any changes or additions to this Agreement constitutes your acceptance of those changes or additions.

3. Scope of Use

3.1 The Service allows Users to access selected television or radio channels through hyperlinks to the desired Third-Party streaming service or live stream. The selection of channels available may change from time to time. The Service may adapt the selection of available channels at short notice, taking into account the interests of both parties, in a manner that is reasonable for the User. The Service is provided free of charge.

3.2 The Service is provided free of charge and without advertising. It is not financed by any source. Free viewing may be accompanied by advertising or log-in requirements on the third-party sites.

3.3 Users can personalize their viewing or listening experience by bookmarking their desired and favorite channels. The bookmarking list is individualized for each browser, and the Service does not collect this list.

3.4 The quality of access depends on the User's internet availability and connection. For technical reasons, the quality of the Service (e.g. access to Third-Parties or the content in those Third-Parties Service as well) may be lower in certain locations (particularly outside of the accessible location of the Channel) and on certain devices.

3.5 The Service is available worldwide, but in some cases, the Third-Party of the content posted on the Service may restrict access to the content in certain territories. Users can decide to use (or not) any technical or other means to circumvent the relevant territorial restriction, for example VPN. The Service is not responsible for such actions. Note that this behaviour is not authorised by some Third-Parties, as it is expressly prohibited even with those measures.

3.6 In every case, the User is and should be granted a simple, non-transferable and non-exclusive right to use the Third-Parties Services (Content) to the extent that this is necessary for the intended, normal use of the respective service. Commercial or business use of Content of third-parties services, or any other use of the Content on a larger scale is expressly and commonly prohibited. The User is therefore not advised or entitled to distribute, copy, edit, upload, share or otherwise use the Content in any way contrary to these Terms and the relevant legal regulations. In particular, the User should not permanently store, "rip", record, copy, share or otherwise reproduce video content locally or make it publicly available to other Third Parties.

3. Age Limits

3.1 Service Age Limit

3.1.1 The Service contains content for all ages, but some content may not be appropriate for children and young people. Parents, guardians, or other adults should supervise children and young people when they use the Service. We recommend that users be over 14 years old to use the Service.

3.1.2 If the Service indicates an age category for a particular piece of content, this means that we do not recommend that children under that age view the content. We determine the age category of content based on its original classification and the nature of the channel.

3.1.3 Some channels may implement a watershed, which is a time of day after which only programming with content that is suitable for mature or adult audiences is permitted. If you are a minor or the person you are watching or listening with is a minor, you should check the channel schedule to see if the program that is playing or will play is suitable for you.

3.2 Access by Minors

3.2.1 A minor is anyone under the age of 18. Minors should agree to not to view sections of the Service, video content, or TV channels that are not intended for their age category.

3.2.2 Adult users (users who have reached the age of majority in their country of residence, but who are at least 18 years old) agree to supervise minors who are accessing and using the Service. Adult users agree not to provide minors with access to sections of the Service or content that is not intended for their age category.


4. Third-Party Related Issues

4.1 The Service is not responsible for the availability or content of any third-party websites or material accessed through the Teraportal website. The Service does not exercise any control or supervision over the content of these linked websites.

4.2 The Service and the User acknowledge that Teraportal and its content, including but not limited to text, images, and logos identifying third parties and/or their products and services, are subject to copyright, design rights, and trademarks and/or other intellectual property rights owned by third parties. The Service does not use such intellectual properties for a commercial purpose. Legitimate copyright holders who wish to have any of the material removed can contact the Service.

4.3 The Service does not particularly endorse any such third party, its products or services, nor does it assume any responsibility for this third party, its products or services. Any relationship that may arise between the User and a third party as a result of interaction with a commercial communication placed on the Website and/or in the Mobile Applications shall be between the User and that third party.

4.4 Third-party websites linked through Teraportal are not covered by these terms and conditions and Teraportal accepts no responsibility for them or for any loss or damage that may arise from your use of them.

4.5 Third-party content may not reflect Teraportal's neutral and non-biased standards, and it may contain distressing material. You acknowledge that you access third-party websites at your own risk.

5. User duties and obligations

5.1 You agree to use the Service only for lawful purposes and in a way that does not infringe on the rights of others or restrict or inhibit their use and enjoyment of the Service.

5.2 You are prohibited from hacking or making any changes or similar actions to the Service that impair or endanger its proper operation.

5.3 You agree to follow general laws and common decency when using the Service, including when choosing a nickname and posting comments. In particular, you agree not to make comment that is:
  • Defamatory
  • Harmful to minors
  • Against good morals or the rights of third parties, including trademarks and names
  • Violates personal rights or copyrights
  • Spam or unauthorised links
  • Doxxing
  • Off-topic

5.4 This Terms of Service and your use of the Service will be governed by the laws of the Country, excluding its conflicts of law rules. Your use of the Service may also be subject to other local, state, national, or international laws.

5.5 If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting the Service. You agree that the original English text of this Terms of Service will prevail in the case of a dispute.

6. Changes to the Service

6.1 The Service may develop Teraportal at any time, add, modify, or remove individual channels, and issue updates. The Service will always take the legitimate interests of the Users into account.

6.2 The Service also reserves the right to change or discontinue Teraportal at any time to improve the functions of the services, adapt the services to changing user habits, adapt to new technical standards and functions of commonly used devices, or to comply with regulatory changes and optimise the security and stability of the Service.

6.3 The Service does not warrant that the functions contained in Teraportal and its content will be uninterrupted or error-free, that defects will be corrected, or that Teraportal or the server that makes it available are free of viruses or bugs.
